The Office of Surface Mining uses this Financial Assistance Manual to show how OSM and its grantees manage Federal grants. This chapter tells how to apply for OSM regulatory program grants.

REGULATORY GRANT PROGRAM
THE APPLICATION PROCESS

5-10R-00 PURPOSE

This chapter establishes OSM processing procedures and provides instructions for applying for OSM regulatory grants and cooperative agreements.

5-10R-10 POLICY

An applicant may apply for Federal assistance at any time during the year to the designated OSM office at least 60 days prior to the beginning of the intended grant period.

5-10R-20 RESPONSIBILITIES

  1. The applicant for an OSM grant is responsible for submitting a complete application to the designated RCC/FO. If requested, OSM shall provide necessary guidance to the applicant during preparation of an application.

  2. The RCC/FO shall confirm receipt of the application inwriting within three working days of receipt.

5-10R-30 APPLICATION REQUIREMENTS

  1. General

    1. Applicants shall submit one signed original and no more than two copies of the complete application.

    2. The completed application shall be submitted to the RCC/FO at least 60 days prior to the intended start of the grant/cooperative agreement.

  2. Application Package. A complete application package for a regulatory grant consists of:

Instructions for the SF424

This is a standard form by application as a required facesheet for preapplications and applications submitted for Federal assistance. It will be used by Federal agencies to obtain applicant certification that the States which have established a review and comment procedure in response to Executive Order 12372 and have selected the program to be included in their review process, have been given an opportunity to review the applicant's submission.

Item number and Entry:

  1. Self-explanatory.

  2. Date application submitted to Federal agency (or State if applicable) & applicant's control number (if applicable).

  3. State use only (if applicable).

  4. If this application is to continue or revise an existing award, enter present Federal identifier number. If for a new project, leave blank.

  5. Legal name of applicant, name of primary organizational unit which will undertake the assistance activity, complete address of the applicant, and name and telephone number of the person to contact on matters related to this application.

  6. Enter employee Identification Number (EIN) as assigned by the Internal Revenue Service.

  7. Enter the appropriate letter in the space provided.

  8. Check appropriate box and enter appropriate letter(s) in the space(s) provided:

  • Name of Federal agency from which assistance is being requested with this application.

  • Use the catalog of Federal Domestic Assistance number and title of the program under which assistance is requested.

  • Enter a brief descriptive title of project. If more than one program is involved, you should append an explanation on a separate sheet. If appropriate (e.g., construction or real property projects), attach a map showing project location. For preapplications, use a separate sheet to provide a summary description of this project.

  • List only the largest political entities affected (e.g., State, counties, cities).

  • Self-explanatory.

  • List the applicant's Congressional District and any District(s) affected by the program or project.

  • Amount requested or to be contributed during the first funding/budget period by each contributor. Value of in-kind contributions should be included on appropriate lines as applicable. If the action will result in a dollar change to an existing award, indicate only the amount of change. For decreases, enclose the amounts in parentheses. If both basic and supplemental amounts are included, show breakdown on an attached sheet. For multiple program funding, use totals and show breakdown using same categories as item 15.

  • Applicants should contact the State Single Point of Contact (SPOC) for Federal Executive Order 12372 to determine whether the application is subject to the State intergovernmental review process.

  • This question applies to the applicant organization, not the person who signs as the authorized representative. Categories of debt include delinquent audit allowances, loans and taxes.

  • To be signed by the authorized representative of the applicant. A copy of the governing body's authorization for you to sign the application as official representative must be on file in the applicant's office. (Certain Federal agencies may require that this authorization be submitted as part of the application.)

    Instructions for the Budget Information Report

    General Instructions:

    Item A - Enter the name of the program for which assistance is being requested.
    Item B - Enter the grantee's name.
    Item C - Enter the name of grant program.
    Item D - Enter rate of Federal sharing.
    Item E - Enter the beginning and ending dates of the budget period for the budget submission.
    Item F - Mark "X" in box to indicate whether it is a new or revised budget.

    Programs/Functions/Activities - For Administrative and Enforcement grants, the vertical columns are used to estimate the costs for the following functions: permitting; inspection and enforcement; lands unsuitable; administrative activities and support costs; and SOAP administrative costs.

    INFORMATION BY FUNCTIONS/ACTIVITIES FOR NONCONSTRUCTION GRANTS

    INSTRUCTIONS FOR COMPLETING BUDGET BY OBJECT CLASS

    1. Personnel. Enter the estimated amount of personnel cost for the program/activity. Attach a list of each position by title, showing annual salary rate and percentage of time, where applicable, to be devoted to the program/activity by the employee.

    2. Fringe Benefits. Enter the estimated amount of fringe benefits. Attach a schedule that describes computation.

    3. Travel. Enter estimated travel expenses. Attach a schedule and show basis for computation (e.g., five trips for 'x' purpose at $80 average cost - $50 transportation and two days per diem at $15; or six people to attend 3-day meeting for 'x' purpose at $115 each -- $70 transportation and $45 subsidence.)

    4. Equipment. Enter total estimated dollar amount of equipment to be purchased, rented or leased. Attach a list of each item of equipment to be purchased, rented or leased, and include the total cost and monthly cost per unit.

    5. Supplies. Enter estimated dollar amount of supplies. Attach a list itemizing the supplies by major type (e.g., office supplies, training materials, research forms, postage), and show basis for computation.

    6. Contractual. Enter estimated dollar amount of the total contracts. On attached list enter the following information for each executed or prospective contract or subcontract:

      1. For individuals to be reimbursed for personal services on a fee basis, list by name, if known, or type of consultant or service, the proposed fee (by day, week or hour), and the amount of time to be devoted to such services.

      2. For companies, organizations, or individuals providing services on a fee basis (including professional associations and educational institutions performing professional services), indicate the type of services to be performed and the estimated contract cost data.

    7. Construction. Enter the costs of minor leasehold improvements. Attach a schedule describing the renovation which will be accomplished using OSM funds and the method used to calculate costs.

    8. Other. Include "other" items not reimbursed as an indirect cost (e.g., rent, reproduction, telephone, janitorial and security services). Attach a list by major type with the basis of calculation.

    9. Total Direct Charges. Enter the sum of items 1 through 8.

    10. Indirect Charges. Include a copy of the approved rate agreement or other approving documentation.

    11. Total. Enter the sum of items 9 and 10.

    Instructions for the OSM 51

    1. Self-explanatory.

    2. Enter the name of the grant applicant.

    3. Enter the name of the program and the project being described.

    4. Enter the name of the performing organization if it is different from the grant or cooperative agreement recipient.

    5. Enter the program narrative statement. As detailed in OMB Circular A-102 (Revised), the Program Narrative Statement should include the followinginformation:

      Objectives and Need for Assistance. Precisely describe any relevant physical, economic, social, financial, institutional or other problems requiring a solution. Demonstrate the need for the assistance and state the principal and subordinate objectives of the project. Supporting documentation or other testimonies from concerned interests other than the applicant may be used. Any relevant data based on planning studies should be included or footnoted.

      Results and Benefits Expected. Identify results and benefits to be derived. For example, show how the facility will be used. For land acquisition or developmental projects, explain how the project will benefit the public.

      Approach. Outline a plan of action pertaining to the scope of the project and detail how the proposed work will be accomplished for each assistance program. Cite factors which might accelerate or decelerate the work and your reasons for taking this approach as opposed to others. Describe any unusual features of the project, such as design or technological innovations, reductions in cost or time, or extraordinary social and community involvements. Provide for each assistance program quantitative projections of the accomplishments to be achieved, if possible. When accomplishments cannot be quantified, list the activities in chronological order to show the schedule of accomplishments and their target dates. Identify the kinds of data to be collected and maintained, and discuss the criteria to be used to evaluate the results and success of the project.

      Explain the methodology that will be used to determine if the needs identified and discussed are being met and if the results and benefits identified are being achieved. List each organization, cooperator, consultant or other key individuals who will work on the project along with a short description of the nature of their effort or contribution.

      Geographic Location. Give the precise location of the project and area to be served by the proposed project. Maps or other graphic aids may be attached.
